HOATown users are subject to the following terms and conditions:
1. License to Use. The HOATown website system is owned and copyrighted by Sonizen, Inc (known as "Sonizen"). Your HOATown community website is made available for your community association's (known as "Association") use through this agreement.
2. Terms of License. License for use of your HOATown community website shall be valid so long as Sonizen continues business operations and Association is current in payments owed to Sonizen. Upon termination of business operations, or Association's failure to keep its account with Sonizen current, this license shall cease and Association's site content and site may be removed from Sonizen's web server.
3. Site Management. Association is responsible for designating a community member to serve as its Community Site Administrator. Sonizen shall not be held responsible for site maintenance or content and Association shall hold Sonizen harmless from any legal action stemming from site's content. The Association is solely responsible for any and all content placed on their community website.
4. Technical Support. Association's Site Administrator shall be responsible for handling support requests from Association's members. Sonizen shall in turn provide support to Association's Site Administrator during regular business hours of 9:00 a.m.- 5:00 p.m. EST, M-F, holidays excepted. Association shall email its support requests to Sonizen at Support@HOATown.com.
5. Fees. Sonizen fees for use of the HOATown system are quoted on HOATown.com, and may be adjusted by Sonizen from time to time upon 30 days written notice to Association by e-mail. Fees for use are billable and due in advance of each billing period (monthly, quarterly, semi-annually, or annually). Failure to pay said fees by the due date will result in suspension and/or cancellation of Association's account and removal from Sonizen's server.
6. 30-Day Money Back Guarantee. If Association cancels its HOATown website by contacting Billing@HOATown.com within 30 days of site creation (not the date of approval of this agreement), then Sonizen shall refund any fees paid less any third party fees for domain registration.
7. Right to Refuse Service. Sonizen has the right to refuse service at any time. If the Association has paid for services in advance, then Sonizen will refund any remaining monies to the Association at the time of refusal.
8. Termination. Association may terminate HOATown use at any time through by emailing HOATown at Support@HOATown.com. Association will be liable for fees for the current billing period at time of cancellation.
9. Authority to Bind Association. The individual creating the HOATown website hereby certifies by creating a website, that he or she is a duly authorized representative or agent of the Association, and is therefore entitled to legally bind the Association to this agreement and all fees due hereunder.
10. Entire Agreement. This shall serve as the full agreement between Sonizen, Inc, owner of HOATown, and Association.
